Noteday Terms of Use
These Terms govern your use of the Noteday app, widgets, feedback service, and related features. Please read them together with the Noteday Privacy Policy.
1. Agreement and service provider
By downloading, installing, accessing, or using Noteday, you agree to these Terms. If you do not agree, do not use Noteday.
Noteday is provided by the provider identified on Noteday’s App Store product page (listed as “铧 杨” on the date of these Terms and referred to below as the “Developer,” “we,” or “us”). Questions and claims may be sent to support@sixiluo.com.
2. Eligibility and accounts
You must have legal capacity to agree to these Terms or use Noteday with permission from a parent or legal guardian. Noteday does not create or manage a separate Noteday account. Any Apple Account or iCloud account you use is provided and governed by Apple.
3. App license and Apple terms
Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, and revocable license to use Noteday on Apple-branded products you own or control, as permitted by the App Store usage rules and Family Sharing where available.
Noteday is distributed through the Apple App Store. Unless Apple presents a custom license agreement for Noteday, Apple’s Standard Licensed Application End User License Agreement applies to the app license. These Terms supplement that agreement and the Apple Media Services Terms. Mandatory law prevails over any inconsistent provision.
4. The service
Noteday helps you create, organize, display, remind, import, back up, synchronize, and share date-based events. Available features may depend on your device, operating system, Apple services, permissions, region, app version, and purchase status.
Noteday is a general organizational tool. It is not an emergency, medical, legal, financial, or safety-critical service. You remain responsible for independently confirming important dates, reminders, and information.
5. Your content
You retain ownership of event titles, notes, images, categories, feedback, and other content you create or choose to import (“Your Content”). You are responsible for ensuring that Your Content is lawful, accurate where necessary, and does not infringe another person’s rights.
You grant us only the limited permission needed to operate features you request, such as storing data through Apple CloudKit, delivering a shared event to recipients you select, or processing feedback. This permission is worldwide only because the relevant service infrastructure may operate globally, is non-exclusive, and ends when the content is deleted from the applicable service, subject to normal backup cycles and legal retention requirements. We do not obtain a license to use Your Content for advertising or unrelated marketing.
When sharing an event, you control the invited recipients. Do not share another person’s information without an appropriate basis or permission. A recipient may independently save or copy shared content, and ending the share cannot retrieve copies already made.
6. Local data, iCloud, and backups
Your data is stored locally by default. If you enable iCloud sync or event sharing, Apple CloudKit stores and transfers the relevant data under your Apple Account and Apple’s terms. We do not receive your Apple Account password and cannot guarantee Apple service availability.
Noteday may let you create, export, inspect, and restore local backup files. You are responsible for protecting exported files and keeping copies appropriate to your needs. Restoring a backup may replace matching records and, if iCloud sync is enabled, may synchronize restored changes to your other devices.
We do not operate a Noteday account backup service and cannot guarantee recovery of deleted, corrupted, incompatible, or unavailable device or iCloud data. Before deleting the app, changing devices, disabling iCloud, or restoring a backup, confirm that you have an appropriate copy of important content.
7. Feedback and diagnostic logs
You may voluntarily submit product feedback. A message must comply with these Terms and must not contain malware, unlawful material, another person’s confidential information without permission, or unnecessary sensitive information.
Noteday automatically includes limited app, system, device, locale, and diagnostic user ID information with feedback. A separate diagnostic log option is off by default and sends a compressed usage-log archive only when you turn it on. Feedback is processed through Cloudflare and Resend and delivered to the support mailbox as described in the Privacy Policy.
You give us permission to read, store, reproduce, and internally share submitted feedback only as needed to provide support, protect the service, and improve Noteday. You do not transfer ownership of your feedback or grant us a right to publish personally identifying material.
8. Permissions, third-party services, and privacy
Some features use Apple system permissions or services, including Calendar, Contacts, Photos, Notifications, iCloud, CloudKit, StoreKit, and the App Store. Their availability and operation are controlled partly by Apple and your settings. Third-party services are governed by their own terms in addition to these Terms.
Our processing of personal information is described in the Noteday Privacy Policy. By using a feature that transmits data, you direct us to process the information needed for that feature, subject to your permission choices and applicable law.
9. In-app purchases
Any in-app purchase offered in Noteday is processed by Apple. The product type, price, currency, included functionality, and any applicable terms are displayed by the App Store or purchase sheet before confirmation. We do not directly collect payment card details.
Billing, taxes, Family Sharing eligibility, purchase restoration, and refund requests are handled under Apple’s applicable rules. You can request a refund through Apple where available. Features are unlocked after Noteday receives and verifies the relevant StoreKit transaction. We may correct an entitlement if a transaction is revoked, refunded, invalid, or no longer verified.
10. Acceptable use
You must not:
- use Noteday or the feedback service unlawfully or to infringe intellectual property, privacy, publicity, or other rights;
- upload malware or harmful code, probe or bypass security controls, interfere with service operation, or abuse rate limits;
- use automated means to scrape, overload, or repeatedly submit content to the feedback service;
- misrepresent your identity or submit knowingly false, deceptive, threatening, hateful, or unlawful material; or
- reverse engineer, redistribute, sell, rent, or sublicense Noteday except to the extent applicable law expressly permits.
11. Intellectual property
Noteday, including its software, interface, graphics, trademarks, and original content, is owned by or licensed to the Developer and is protected by applicable intellectual property law. These Terms do not transfer ownership of Noteday or third-party materials to you. Open-source components remain subject to their respective licenses.
12. Changes, availability, and support
We may update Noteday to add, change, or remove features; address security or compatibility issues; or comply with law. We aim to avoid materially reducing paid functionality without a valid reason, but we do not guarantee that every feature will remain available indefinitely or work on every device or operating-system version.
We are responsible for Noteday maintenance and support as required by applicable law. Apple has no obligation to provide maintenance or support for Noteday. Network features may be interrupted by maintenance, outages, regional restrictions, or circumstances outside our reasonable control.
13. Suspension and termination
You may stop using Noteday and delete it at any time. Because Noteday has no separate account, there is no Noteday account to close. You remain responsible for deleting local, iCloud, shared, or exported copies as appropriate.
We may restrict access to server-side features such as feedback when reasonably necessary to address abuse, security threats, legal requirements, or material violations of these Terms. Where practical, the restriction will be proportionate and limited to the affected feature.
14. Warranties and disclaimers
To the maximum extent permitted by law, Noteday is provided “as is” and “as available.” We do not promise uninterrupted or error-free operation, perfect reminder delivery, compatibility with every device, or recovery of all data. Nothing in these Terms excludes warranties, remedies, or other rights that cannot lawfully be excluded, including mandatory consumer guarantees.
If Noteday fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app, if any, as provided by Apple’s applicable terms. To the maximum extent permitted by law, Apple has no other warranty obligation for Noteday, and the Developer remains responsible for other legally required warranties.
15. Limitation of liability
To the maximum extent permitted by law, neither the Developer nor its service providers will be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, opportunities, or goodwill arising from use of or inability to use Noteday. This limitation does not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or mandatory consumer protection law.
16. Third-party claims and legal compliance
The Developer, not Apple, is responsible for addressing claims relating to Noteday or your possession and use of it, including product liability, legal or regulatory compliance, consumer protection, and claims that Noteday infringes a third party’s intellectual property rights, except to the extent another party is legally responsible.
You must comply with applicable law and represent that you are not prohibited from using Noteday under applicable trade sanctions or export-control restrictions.
17. Changes to these Terms
We may update these Terms when features, business practices, Apple requirements, or applicable law change. We will update the date at the top and provide a prominent notice for material changes where reasonably possible. Changes apply prospectively from their stated effective date. If you do not agree to revised Terms, stop using Noteday.
18. Governing law and disputes
These Terms are governed by the law applicable to the Developer’s provision of Noteday, without depriving you of mandatory consumer rights or protections available where you live. Before starting formal proceedings, please contact us and allow a reasonable opportunity to resolve the concern. An unresolved dispute may be brought before a court or other forum with jurisdiction under applicable law.
19. General terms
If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer these Terms except where law permits; we may transfer them as part of a reorganization or transfer of Noteday, subject to applicable notice and privacy obligations.
